Scope of this Policy

本政策適用於所有歐洲經濟區（EEA）、英國及瑞士地區的最終使用者。如您與 Orban 簽訂合約或使用了整合本政策的 Orban 產品，您必須確保遵守下列義務，否則 Orban 可能會限制、暫停您對產品的使用，或終止合約。
This policy applies to all end users in the European Economic Area (EEA), the UK, and Switzerland. If you have an agreement with Orban or use an Orban product incorporating this policy, you must comply with the following requirements. Failure to do so may result in limitation, suspension, or termination of your access to Orban products.

您自主管理之平台
Your Properties Under Control

• 依法取得最終使用者對於「Cookie 或其他本地儲存」的有效同意
  Obtain valid consent for cookies or other local storage where legally required.
• 依法取得最終使用者對於「個人資料蒐集、分享與廣告個人化使用」的有效同意
  Obtain valid consent for collection, sharing, and use of personal data for ad personalization.

您應：
You must:

• 保留每位使用者之同意紀錄
  Retain records of consent given by end users.
• 提供簡易明確的同意撤回方式
  Provide clear instructions for revoking consent.
• 揭露所有可能蒐集、接收或使用個人資料之相關方
  Clearly identify all parties that may collect, receive, or use personal data.

第三方平台之責任
Responsibilities on Third‑Party Properties

若因使用 Orban 產品而使第三方平台傳遞或共享使用者個人資料予 Orban，您應以商業上合理之努力，確保該平台營運者亦遵守上述義務。
If a third‑party property shares personal data of its end users with Orban due to your integration, you must use commercially reasonable efforts to ensure that operator also complies with the above duties.

使用 Orban 服務即表示您同意本使用者條款。如不同意，請勿使用。
By using Orban’s services, you agree to these Terms. If you do not agree, please do not use our services.

2. 服務範圍
2. Service Scope

Orban 提供分散式 GPU 雲端算力，依契約與計費方案提供即時運算資源。
Orban provides decentralized GPU cloud compute services, delivering on‑demand compute resources according to your agreement and pricing plan.

3. 使用者義務
3. User Obligations

• 不得從事任何違法或侵害第三方權益之行為；
  Do not engage in unlawful activities or infringe upon third‑party rights.
• 妥善保管您的帳號與 API 金鑰，不得轉讓或洩露；
  Safeguard your account and API keys; do not transfer or disclose them.
• 遵守 GDPR/EU 隱私法規與相關條款；
  Comply with GDPR/EU Privacy Policy and related regulations.

4. 費用與付款
4. Fees & Payment

您同意依照 Orban 計費方案支付費用。逾期未付款將可能導致服務中斷或帳戶停用。
You agree to pay fees according to Orban’s pricing plans. Late or non‑payment may result in service suspension or account deactivation.

5. 責任限制
5. Limitation of Liability

在適用法律允許範圍內，Orban 不對任何間接、附帶或衍生性損害負責。
To the fullest extent permitted by law, Orban is not liable for any indirect, incidental, or consequential damages.

6. 條款變更
6. Changes to Terms

Orban 得隨時更新本條款，並於網站公告生效日期。繼續使用即視為同意更新後條款。
Orban may update these Terms at any time by posting the changes on our website with an effective date. Continued use constitutes acceptance of the updated Terms.
